Text Message Terms and Conditions

     
  1. By opting in to text messaging you authorize Ambit Energy to use autodialer or non-autodialer technology to send text messages to the wireless phone number associated with your opt-in. You do not have to opt in to text messaging to receive service from Ambit Energy.

  3. You must be the owner or authorized user of the associated phone number to opt in to receive text messages from Ambit Energy.

  5. You can opt in to text messaging by calling Customer Care, subscribing during enrollment, or logging in to your Ambit account online at my.ambitenergy.com. Then follow the instructions of the initial text message you receive to complete the opt in process.

  7. You can opt out of text messaging by texting “STOP” at any time to 26248, 36745 and 44227. You can also opt out by calling Customer Care, logging in to your Ambit account online at my.ambitenergy.com, or replying “STOP” to Ambit Energy’s text message on your wireless device. You will receive a text confirming that you have been unsubscribed from Ambit Energy text messages.

  9. Ambit Energy does not charge a fee for text messages. Message and data rates may apply from your wireless carrier. Depending on your text plan, you may be charged for text messages by your wireless carrier.

  11. Ambit Energy is not liable for delays in your receipt of any text messages. Delivery depends on the transmission of text messages by your wireless carrier. T-Mobile is not liable for delayed or undelivered messages.

Data Ambit Energy obtains from you via text message may include your wireless phone number, your carrier’s name, the date, time and content of your messages, and any other information you transmit to Ambit Energy. We may use this information to contact you in the future, depending on the types of communications you opt in to receive from Ambit Energy.

  17. Supported carriers include Verizon Wireless, AT&T, T-Mobile, Metro PCS, Sprint, Boost, Virgin Mobile USA, U.S. Cellular.

  19. The number of messages you receive may vary by month, depending on the types of communications you opted in to receiving.

  21. Text messaging is currently available only to subscribers with U.S. phone numbers.

  23. If you have questions, reply “HELP” to the texting short code you are receiving Ambit Energy text messages from or contact Ambit at 877-282-6248.

Any dispute or claim arising out of or relating in any way to text messaging will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The Federal Arbitration Act and federal arbitration law apply to these Terms and Conditions.

BY AGREEING TO ARBITRATION, YOU UNDERSTAND AND AGREE THAT YOU ARE WAIVING YOUR RIGHT TO MAINTAIN OTHER AVAILABLE RESOLUTION PROCESSES, SUCH AS A COURT ACTION OR ADMINISTRATIVE PROCEEDING, TO SETTLE ANY DISPUTES OR CLAIMS. THE RULES IN ARBITRATION ARE DIFFERENT. THERE IS NO JUDGE OR JURY. ALTHOUGH REVIEW IS LIMITED, AN ARBITRATOR CAN AWARD ON AN INDIVIDUAL BASIS THE SAME DAMAGES AND RELIEF AS WOULD BE AVAILABLE IN COURT AND MUST ENFORCE THE SAME LIMITATIONS STATED IN THESE TERMS AND CONDITIONS AS A COURT WOULD.

THE FEDERAL ARBITRATION ACT AND APPLICABLE FEDERAL LAW (OR IN THE ABSENCE OF APPLICABLE FEDERAL LAW, THEN THE LAWS OF THE STATE OF TEXAS), WITHOUT REGARD TO PRINCIPLES OF CONFLICT OF LAWS, WILL GOVERN THESE TERMS & CONDITIONS AND APPLY TO ANY DISPUTES OR CLAIMS AGAINST AMBIT ENERGY ARISING OUT OF OR RELATING IN ANY WAY TO ANY AMBIT ENERGY TEXT MESSAGE SERVICE.
